Trading Risk Disclosure for TrendOrFlat
1. General
1.1. This risk disclosure explains the limits of the TrendOrFlat informational/analytical service (the "Service"), owned by Olga Igorevna Ilina, a self-employed individual, Tax ID (INN) 501803615021 (the "Operator"), before the User decides to use the Service in connection with real or simulated trading.
1.2. This document is an integral part of the Public Offer and must be read together with it and with the Privacy Policy.
1.3. Using the Service to make trading decisions means the User has reviewed this document and accepts the risks described below at their own account.
2. Risk of capital loss
2.1. Trading in financial and cryptocurrency markets, including BTCUSDT, carries a high risk and may lead to total or partial loss of invested capital, regardless of whether the User uses the Service.
2.2. Cryptocurrency market volatility can exceed that of traditional markets; sharp price moves are possible at any time, including during periods of low liquidity and outside normal trading hours.
3. Nature of the Service's regime forecasts
3.1. The Service classifies the likely market condition (TREND, FLAT, or OFF) based on analysis of news and macroeconomic factors using large language models (LLMs), and does not use BTC price or technical analysis as forecast input.
3.2. A regime classification is a probabilistic estimate, not a guaranteed fact. A forecast can be wrong, lagging, or fail to match how the market actually develops.
3.3. OFF means the Service's recommendation to pause the User's trading bots and is not a guarantee against loss: the market can move in any direction during an OFF regime, and technical failures may prevent timely application of the signal.
3.4. The news and macro sources used by the LLMs may contain inaccuracies, delays, or discrepancies; the Operator does not guarantee the completeness or timeliness of such sources.
4. No individual investment advice
4.1. The Service is not an investment adviser, broker, or trustee and does not provide individual investment advice tailored to a particular User's financial situation, goals, or risk tolerance.
4.2. All analysis, text, and reasoning published by the Service (including in the "History," "Accuracy," and "Insights" sections) is informational in nature.
5. Historical accuracy and simulated results
5.1. Published forecast history and accuracy figures reflect past, verified results under a fixed methodology and do not guarantee similar results in the future.
5.2. The Simulator at /simulator builds a retrospective scenario from a trade file uploaded by the User and processes data only in the User's browser. Simulation results are hypothetical: they do not account for slippage, the full scope of fees, the liquidity of a specific trade, and do not reflect actual order execution.
5.3. Hypothetical and simulated results have material limitations compared with actual trading and should not be treated as a promise of future returns.
6. User responsibility and control
6.1. The User independently determines the trading strategy, position size, tools used, and order of trade execution. The Operator does not place trades, does not manage the User's funds or accounts, and has no access to the User's trading accounts.
6.2. The User must independently assess whether it is appropriate to apply the Service's signals to their own trading system, including testing the integration and configuring fail-safe behavior on their own side.
7. Technical and integration risks
7.1. Failures, delays, or errors in the Service are possible, including delays from news and market-data providers, cloud infrastructure, LLM providers, messaging platforms (Telegram), and exchanges.
7.2. The Service's integrations with TSLab, MT5, TradingView, 3Commas, and other platforms depend on correct configuration on the User's side and on the availability of third-party platforms; the Operator is not liable for failures of third-party platforms.
7.3. The User is advised to implement their own fail-safe behavior (for example, disabling automated trading) in case the Service's signal becomes unavailable.
8. Limitation of liability
8.1. The Operator is not liable for trading losses, lost profit, or decisions made solely on the basis of Service information, except where such a limitation is prohibited by applicable law.
8.2. Liability-limitation terms and mandatory consumer rights are set out in Section 12 of the Public Offer and are not limited by this document.
9. Changes to this document
9.1. This risk disclosure may be updated as the Service's functionality changes. The current revision is always available at /risk-disclosure; archived revisions are kept at permanent links such as /legal/archive/risk-disclosure/{version}.
